Jury finds store was not negligent in Calhoun City injury case

A Calhoun County jury ruled in favor of the Fred’s store in Calhoun City Tuesday in a lawsuit from a customer claiming his child was injured due to the store’s negligence.

Timothy Oswald, who was represented by Richard D. Underwood,  sued the store on behalf of his son whom he said was injured in December of 2011 when he tripped over a ball in the middle of the aisle. The filed complaint said the child fell hitting his head on the floor, after which he was taken to the emergency room where six stitches were needed.

The jury found the store had not been negligent in contributing to the injuries of the child.

The trial began Monday afternoon and concluded Tuesday afternoon.

Judge Robert Elliott presided over the case.
